Acceptance of Terms

By accessing, downloading, installing, or using the Go! Trip application or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and Go! Trip ("we," "us," or "our").

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes acceptance of the revised Terms.

Age Requirements: You must be at least 13 years of age to use the Service. If you are located in the European Economic Area (EEA), you must be at least 16 years of age, or the minimum age required by the data protection laws of your country if different. By using the Service, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into a binding agreement. If you are between the applicable minimum age and the age of legal majority in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" as used herein refers to both you individually and the organization.

Description of Service

Go! Trip is a technology platform and AI-powered planning tool that helps users create personalized travel itineraries. The Service uses artificial intelligence, the Google Places API, the Google Routes API, and publicly available data to combine your stated preferences and generate day-by-day travel itinerary suggestions for single-city and multi-destination trips.

The Service enables you to input your travel preferences, including destinations, dates, dietary restrictions, accessibility requirements, travel party type, and activity interests. Based on these inputs, our AI generates suggested itineraries that include points of interest, estimated travel times, and other planning information. You may also upload photos as "Moments" to document your travels.

Go! Trip does not control, operate, own, or manage any of the venues, attractions, restaurants, transportation services, or other businesses or locations that may appear in your itinerary. We are not responsible for the availability, quality, safety, legality, or accuracy of information about any third-party venue or service. Conditions at destinations, including operating hours, prices, accessibility, and availability, may change without notice and may differ from information displayed in the Service.

You acknowledge and agree that any decision to visit a destination, book travel arrangements, or follow an itinerary suggestion is made entirely at your own risk and discretion. You are solely responsible for independently verifying all information, making your own travel arrangements, obtaining necessary travel documents (such as visas and travel insurance), and ensuring your personal safety.

Google API Attribution

This Service uses the Google Maps Platform APIs, including the Google Places API and the Google Routes API, to provide location-based information and route calculations within your travel itineraries.

Data obtained from Google through these APIs is subject to the Google Terms of Service and the Google Privacy Policy [Google Privacy Policy]. By using the Service, you also agree to be bound by the Google Maps/Google Earth Additional Terms of Service.

Google and the Google logo are registered trademarks of Google LLC. Go! Trip is not endorsed by, affiliated with, or sponsored by Google. The use of Google APIs does not imply any endorsement or partnership between Go! Trip and Google.

Location data, place information, ratings, reviews, photos, and routing information provided through Google APIs may be subject to additional terms and conditions imposed by Google. We encourage you to review Google's terms and privacy policy for more information about how Google processes data.

Account Registration

To use certain features of the Service, you must create an account by providing a valid email address and creating a password. You may optionally provide your name. By creating an account, you agree to the following:

• Accuracy: You will provide accurate, current, and complete information during registration and will keep your account information updated. You will not use a false identity or provide misleading information.
• One Account Per Person: Each individual may maintain only one account. Creating multiple accounts for the purpose of circumventing restrictions, abusing features, or any other reason is prohibited.
• Non-Transferability: Your account is personal to you and may not be transferred, sold, assigned, or shared with any other person or entity. You may not allow any other person to access the Service using your credentials.
• Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [email protected] if you suspect any unauthorized access to or use of your account.
• Responsibility: You are responsible for all activities that occur under your account, whether or not you have authorized such activities. We are not liable for any loss or damage arising from unauthorized use of your account.

We reserve the right to suspend, disable, or delete your account if we determine, in our sole discretion, that you have violated any provision of these Terms or that any information provided during registration is inaccurate, misleading, or fraudulent.

Acceptable Use

You agree to use the Service only for its intended purpose of personal travel itinerary planning and in compliance with all applicable laws and regulations. You agree NOT to:

• Scraping and Data Extraction: Use any automated means, including bots, crawlers, scrapers, spiders, or data mining tools, to access, collect, copy, or extract data from the Service.
• Reverse Engineering: Reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive the source code, algorithms, data models, or underlying architecture of the Service or its AI systems.
• Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Illegal or Harmful Content: Use the Service to plan, promote, or facilitate any illegal activity, or to generate, transmit, or store content that is unlawful, defamatory, threatening, harassing, obscene, or otherwise objectionable.
• AI Abuse: Attempt to manipulate, bypass, or exploit the AI system through prompt injection, adversarial inputs, jailbreaking, or any technique designed to cause the AI to produce unintended, harmful, misleading, or unauthorized outputs.
• Commercial Resale: Resell, redistribute, sublicense, or commercially exploit the Service, its output, or any data obtained from the Service without our prior written consent.
• Unauthorized Automated Access: Access the Service through any automated means (including APIs, scripts, or bots) without our prior written authorization.
• Interference: Interfere with or disrupt the integrity, performance, or availability of the Service, its servers, or its networks, including through denial-of-service attacks, malware distribution, or excessive load generation.
• Security Circumvention: Attempt to bypass, circumvent, or disable any security features, access controls, authentication mechanisms, or usage restrictions of the Service.
• Framing and Misrepresentation: Frame, mirror, or present the Service or any portion thereof in a manner that suggests endorsement by, affiliation with, or sponsorship by Go! Trip when none exists.
• Spam and Unsolicited Communications: Use the Service to send spam, unsolicited messages, or bulk communications of any kind.

We reserve the right to investigate and take appropriate action against any violation of this section, including suspending or terminating your account, removing content, and reporting violations to law enforcement authorities.

AI-Generated Content

Go! Trip uses artificial intelligence to generate travel itinerary suggestions based on your inputs and publicly available information. You acknowledge and agree to the following regarding AI-generated content:

• No Guarantee of Accuracy: AI-generated content may contain inaccuracies, errors, or outdated information regarding operating hours, prices, availability, accessibility, directions, distances, travel times, local regulations, safety conditions, or any other details about destinations, venues, or services.
• No Guarantee of Availability: Places, attractions, restaurants, and other venues suggested in your itinerary may be temporarily or permanently closed, relocated, fully booked, or otherwise unavailable at the time of your visit.
• No Guarantee of Safety: Inclusion of a destination, route, or activity in an AI-generated itinerary does not constitute a representation that the destination, route, or activity is safe, suitable for your specific circumstances, or free from hazards.
• Dynamic Conditions: Travel conditions, local regulations, weather, political situations, public health conditions, and other factors affecting travel may change rapidly and without notice. AI-generated content may not reflect the most current conditions.
• User Responsibility: You are solely responsible for all decisions made based on or influenced by AI-generated suggestions, including but not limited to decisions regarding travel routes, timing, venues to visit, and activities to undertake.

Go! Trip expressly disclaims all liability for any loss, damage, injury, inconvenience, or expense of any kind arising from or related to your reliance on AI-generated itinerary content. By using the Service, you accept full responsibility for verifying the accuracy and suitability of all AI-generated suggestions before acting on them.

Third-Party Content and Services

The Service may display, include, reference, or link to content, data, and services provided by third parties ("Third-Party Content"). This includes, but is not limited to:

• Google Places Data: Place information, ratings, reviews, photos, operating hours, and other venue data obtained through the Google Places API. This data is subject to Google's Terms of Service and may be updated or removed by Google at any time.
• Google Routes Data: Route calculations, travel time estimates, and distance information obtained through the Google Routes API. This data is subject to Google's Terms of Service.
• User-Submitted Content: Content contributed by other users of the Service, including photos, notes, and reviews. User-submitted content represents the views and experiences of individual users and does not reflect the opinions or endorsements of Go! Trip.
• External Links: The Service may contain links to third-party websites, applications, or services. We do not control, endorse, or assume responsibility for the content, privacy policies, practices, or availability of any linked third-party resources.

Any travel bookings, reservations, purchases, or arrangements you make with third-party travel services, airlines, hotels, tour operators, restaurants, transportation providers, or any other third party are entirely your own responsibility. Go! Trip is not a party to any transaction between you and any third party, and we have no obligation or liability with respect to such transactions.

We do not warrant the accuracy, completeness, reliability, or timeliness of any Third-Party Content displayed through the Service. Your interactions with third-party services and providers are governed solely by the terms and policies of those third parties.

Intellectual Property

Go! Trip Intellectual Property: The Service, including its software, source code, algorithms, AI models and systems, user interface design, visual design, graphics, logos, icons, trademarks, service marks, trade names, domain names, and all other intellectual property embodied in or associated with the Service, are the exclusive property of Go! Trip and its licensors. All rights are reserved. Nothing in these Terms grants you any right, title, or interest in or to our intellectual property except for the limited right to use the Service as expressly permitted by these Terms.

Limited License to Use the Service: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service on your personal devices for your personal, non-commercial travel planning purposes. This license does not permit you to copy, modify, distribute, sell, lease, or create derivative works based on the Service or any portion thereof.

Your Content: You retain ownership of all content you create, upload, or submit through the Service, including photographs, notes, trip names, and other user-generated materials ("Your Content"). By submitting Your Content to the Service, you grant Go! Trip a limited, non-exclusive, royalty-free, worldwide license to use, store, reproduce, display, and process Your Content solely for the purpose of operating, maintaining, and providing the Service to you. This license includes the right to store your photos in our cloud infrastructure and display them back to you within the app.

This license to Your Content terminates when you delete the relevant content or your account, except that: (a) copies that have been shared by you with other users may persist in those users' accounts, and (b) a reasonable period of time may be required to remove content from our backup systems. We will delete Your Content from active systems within 30 days of account or content deletion.

You represent and warrant that you own or have the necessary rights and permissions to submit Your Content and to grant the license described above, and that Your Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights.

Subscriptions and Payments

Go! Trip currently offers a free tier that provides access to the core functionality of the Service. We plan to introduce paid subscription plans in the future that may include additional features, higher usage limits, or premium capabilities.

Free Tier: The current free tier will continue to provide existing core functionality. We reserve the right to modify the features included in the free tier, but we will provide reasonable notice of any material reductions in free tier functionality.

Future Paid Plans: When paid subscription plans become available, the specific pricing, billing cycles, features included, and all applicable terms and conditions will be published within the Service and on our website before any paid plan is activated. No charges will be made without your explicit, informed consent.

Payment Processing: Payment processing for future paid plans will be handled by RevenueCat in conjunction with the Apple App Store (for iOS) and Google Play Store (for Android). In-app purchases and subscriptions will be subject to the billing terms and policies of the respective app store through which you made your purchase, including refund policies. You should review the applicable app store's terms before making any purchase.

No Current Charges: As of the date of these Terms, no paid plans are active and no payment information is collected or processed. This section will be updated and expanded before the introduction of any paid features. We will notify existing users via email and/or in-app notification before any paid plans are launched.

Disclaimers

To the maximum extent permitted by applicable law, Go! Trip expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing, usage, or trade practice.

Without limiting the foregoing, Go! Trip makes no warranty or representation that:

• The Service will meet your specific requirements or expectations.
• The Service will be uninterrupted, timely, secure, or error-free.
• The results or information obtained through the Service will be accurate, reliable, complete, or current.
• Any AI-generated itinerary suggestion is suitable, safe, or appropriate for your particular circumstances, health conditions, physical capabilities, or travel requirements.
• The quality of any destinations, venues, routes, or activities suggested through the Service will meet your expectations.
• Any errors in the Service will be corrected.

AI-generated content is not professional travel advice. Go! Trip is not a travel agency, tour operator, or licensed travel advisor. You should not rely solely on the Service for travel planning decisions without independent verification from authoritative and up-to-date sources.

Go! Trip is not responsible for and disclaims all liability in connection with: cancellations, delays, or disruptions to travel plans from any cause; inaccurate or outdated place data, including operating hours, prices, ratings, or reviews; changes in conditions, regulations, or safety situations at destinations; any acts, omissions, or defaults of third-party service providers, transportation operators, accommodation providers, tour operators, or any other third party; and any personal injury, property damage, or other harm arising from your travel activities.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on consumer rights. In such jurisdictions, the above disclaimers apply only to the extent permitted by applicable law. Nothing in these Terms excludes or limits any mandatory statutory rights that cannot be excluded or limited under the applicable law of your jurisdiction, including mandatory consumer protection laws.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Go! Trip, its officers, directors, employees, agents, affiliates, successors, or assigns be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, use, or other intangible losses, regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Go! Trip has been advised of the possibility of such damages.

Without limiting the foregoing, Go! Trip shall not be liable for any damages arising from or related to: your reliance on AI-generated itinerary suggestions; inaccurate, incomplete, or outdated information provided through the Service; your interactions with third-party services, venues, or travel providers; unauthorized access to or alteration of your account or data; travel cancellations, disruptions, delays, or changes in conditions at any destination; or any matter beyond our reasonable control.

To the maximum extent permitted by applicable law, the total aggregate liability of Go! Trip for all claims arising out of or relating to these Terms or your use of the Service shall not exceed the greater of (a) one hundred United States dollars (USD $100.00) or (b) the total amount of fees you have actually paid to Go! Trip in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the applicable mandatory laws of your jurisdiction.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Go! Trip, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

• Your violation of any provision of these Terms or any applicable law or regulation.
• Your misuse of AI-generated content or itinerary suggestions, including any actions taken in reliance on such content without independent verification.
• Your reliance on any itinerary, route, destination suggestion, or other information provided through the Service without independently verifying its accuracy, safety, and suitability for your circumstances.
• Any content you submit, upload, or transmit through the Service, including photographs, notes, or other user-generated content, that infringes, misappropriates, or violates any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights.
• Any third-party claim arising from your use of the Service or your travel activities planned using the Service.
• Your negligence, willful misconduct, or fraud.

This indemnification obligation shall survive the termination or expiration of these Terms and your use of the Service. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

In jurisdictions where indemnification clauses are restricted or unenforceable against consumers, this section applies only to the extent permitted by applicable law.

Termination

Termination by You: You may close your account and stop using the Service at any time. You can delete your account through the app settings or by contacting us at [email protected]. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy, including deletion of account information, trip data, and uploaded photos from active systems within 30 days.

Termination by Go! Trip: We reserve the right to suspend, restrict, or terminate your account and access to the Service, with or without notice, at our sole discretion, for any reason, including but not limited to: violation of these Terms; conduct that we determine, in our sole discretion, is harmful to other users, the Service, or Go! Trip; prolonged inactivity; or request by law enforcement or government authorities.

Where reasonably practicable and not prohibited by law, we will attempt to provide you with notice and an opportunity to remedy any violation before terminating your account. However, we reserve the right to terminate immediately without notice in cases of severe or repeated violations, illegal activity, or where continued access poses a risk to the Service or other users.

Effect of Termination: Upon termination, your right to access and use the Service will immediately cease. The following sections of these Terms shall survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any other provisions that by their nature should survive.

Termination of your account does not relieve you of any obligations incurred prior to termination, including any payment obligations for paid features (when applicable).

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, including but not limited to the Brazilian Civil Code (Lei 10.406/2002), the Brazilian Consumer Defense Code (Lei 8.078/1990), the Brazilian Internet Civil Framework (Lei 12.965/2014 - Marco Civil da Internet), and the Brazilian General Data Protection Law (Lei 13.709/2018 - LGPD), without regard to conflict of law principles.

Mandatory Consumer Protection Laws: Nothing in these Terms shall be construed to exclude, restrict, or modify the application of any mandatory consumer protection laws of your jurisdiction that cannot be excluded by agreement. If you are a consumer in the European Union, you shall benefit from any mandatory provisions of the law of your country of residence. If you are a consumer in the United States, state consumer protection statutes may apply regardless of the governing law provision above.

Informal Dispute Resolution: Before initiating any formal legal proceeding, you and Go! Trip agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through good-faith negotiation. You agree to send a written description of the dispute to [email protected], and we will attempt to resolve it within 30 days.

Jurisdiction: If informal resolution is unsuccessful, any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of the city of Sao Paulo, State of Sao Paulo, Brazil, without prejudice to the right of consumers to initiate proceedings in the courts of their domicile as provided by applicable consumer protection law.

EU Residents: If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform, available at ec.europa.eu/consumers/odr, to resolve disputes online.

Changes to These Terms

We reserve the right to modify, amend, or replace these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms.

For material changes that significantly affect your rights or obligations, we will provide at least 30 days' advance notice before the changes take effect. Notice will be provided via email to the address associated with your account and/or through a prominent in-app notification. Examples of material changes include modifications to the limitation of liability, changes to dispute resolution procedures, or introduction of new data processing activities.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the updated terms. If you do not agree with the revised Terms, you must stop using the Service and close your account before the effective date. We will include instructions for account closure in any notification of material changes.

Non-material changes, such as corrections of typographical errors, formatting adjustments, or clarifications that do not alter the substance of the Terms, may take effect immediately upon posting. We encourage you to review these Terms periodically.
